NO SMOKING IN PARKS OR ON TRAILS
The City of Lincoln has passed a “No Smoking in Parks or on Trails” ordinance which takes effect Thursday, November 23, 2017. This ordinance prohibits the smoking of any tobacco, plant, or any other substance in public parks, equestrian pathways, hiking and running trails, bike pathways, and other public trails throughout the City. This ban also includes e-cigarettes, cigars, and other similar devices as well.
Per the ordinance, [i]t shall be unlawful for any person to Smoke within the perimeter of any city park [or] ... on any equestrian, hiking, bike and similar trails... 'Smoking' means inhaling, exhaling, burning, or carrying any lighted cigar, cigarette, hookah pipe, plant or other combustible substance in any manner or in any form and use of electronic devices with electrical ignition or vaporization (e-cigarettes/cigars or similar devices)... A violation of any of the provisions of this chapter may be an infraction and punishable by a fine not exceeding $100.00 and subject to exclusion from the park." (Lincoln Municipal Code §12.20.190)
